EEO-1 Reporting and Filing

The US Equal Employment Opportunity Commission (EEOC) conducts an annual EEO-1 Survey for private sector employers. This is not a voluntary survey, but one required by the Civil Rights Act of 1964. The data collected is used for a variety of purposes, including enforcement, self-assessment, and research. EEOC also shares the data it gathers with the Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) as one of the factors used in selecting contractors for Compliance Evaluations under regulations for Affirmative Action Programs. The EEO-1 Survey requires employee data of the ending date of any payroll period in fourth quarter of the current calendar year, and the survey is due on March 31st of the following year.

VETS Reporting and Filing

The U.S. Department of Labor Veterans’ Employment and Training service (VETS) and Office of Federal Contract Compliance Programs (OFCCP) have supported affirmative action to employ and advance in employment, “covered veterans” since 2008. As legislatively mandated under 38 U.S. Code, Section 4212, codified at 41 CFR Section 61-300, contractors and subcontractors who enter into, or modify a contract or subcontract with the federal government, and whose contract meets the criteria set forth in the above legislation/regulations, are required to report annually on their affirmative action efforts in employing veterans. VETS has a legislative requirement to collect, and make available to OFCCP, reported data contained on a new reporting form in 2015, the VETS-4212 report, for compliance enforcement. The VETS-4212 report requires employee data of the ending date of any payroll period between July 1st and August 31st as well as new hires data of the preceding twelve-month.  VETS-4212 is due annually on September 30th.

Gerstco can prepare and submit Company EEO-1 forms to EEOC’s Joint Reporting Committee electronically, in hard copy or via the EEO-1 online system, on an annual basis, as required.

EEO-1 reporting consists of the following:

  • A Consolidated Report (all US locations)
  • A Headquarters Report
  • Individual Establishment reports (employing 50, or more individuals)
  • Summary Listings (for locations employing less than 50 individuals)

Gerstco can prepare and submit VETS-4212 forms to DOL’s Veterans’ Employment and Training Services (VETS) via the VETS online system, on an annual basis, as required.

VETS-4212 reporting consists of the following:

  • A Headquarters Report
  • Individual Establishment reports (employing 50, or more individuals)
  • State Consolidated Reports (for locations employing less than 50 individuals)
